End User License Agreement

1. Licensed, not sold

This agreement is between you and DRILY, not Apple. The DRILY app is licensed to you, not sold. DRILY, not Apple, is solely responsible for the app and its content.

2. License

We grant you a personal, non-exclusive, non-transferable license to use the app on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app may also be used by other accounts associated with you through Family Sharing or volume purchasing.

3. Restrictions

You may not copy the app except as the license allows, sell, rent or sublicense it, reverse engineer or modify it except where the law permits, or remove proprietary notices.

4. Maintenance and support

DRILY is responsible for maintenance and support of the app: support@drily.org. Apple has no obligation to provide maintenance or support for the app.

5. Warranty

To the extent permitted by law, the app is provided “as is”. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app; any other claims, losses or costs are DRILY’s responsibility.

6. Product claims

DRILY, not Apple, is responsible for addressing claims relating to the app or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.

7. Intellectual property claims

If a third party claims that the app or your use of it infringes its intellectual property rights, DRILY, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.

8. Legal compliance

You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-party terms

When using the app you must comply with applicable third-party terms — for example, your mobile data agreement and the terms of the services you open through DRILY.

10. Third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of this agreement. Once you accept it, Apple has the right to enforce it against you as a third-party beneficiary.

11. Termination and contact

The license is effective until terminated. It ends automatically if you break this agreement; you must then stop using the app and delete it.
